Partner Lisa Stone practices in the area of public and administrative law with a focus on the energy and clean technology industry. Ms. Stone has over two decades experience representing leading companies in federal and state administrative and contracting matters involving energy and environmental issues. She has an end-to-end practice advising companies that are pursuing public funding opportunities for renewable energy and clean tech projects, from evaluating available funding opportunities and structuring proposals, negotiating the funding instrument with the federal agency, and ongoing compliance during administration of the project. Ms. Stone has worked on a wide range of public contracts for highly regulated entities, including publicly funded research and development projects, joint infrastructure development initiatives and sales of utility services to public entities. As a result, she has deep experience with the unique laws and regulations that apply to public works projects, including Buy America, prevailing wage, public works statutes, and federal contractor compliance requirements.
Ms. Stone also has extensive experience in a wide range of environmental and energy compliance and regulatory matters involving energy efficiency, hazardous waste, hazardous materials, water safety and air emissions, including DOE’s EPCA conservation standards, Energy Star, California’s VOC emission standards, consumer products and Prop 65. In addition to providing advice and counseling, Ms. Stone has deep experience in designing and building effective compliance programs. She has served as external in-house counsel for energy and environmental matters for multiple clients and is known for giving practical, effective and efficient advice.
Representative Experience
Government Grants and Contracts
- Lead attorney on more than $100 million in clean energy federal and state research and development grants.
- Drafted and negotiated more than 50 subrecipient and subcontractor agreements with national laboratories, universities, nonprofit organizations and for-profit companies.
- Managed all legal support for public contracts with federal, state and local agencies for Fortune 500 investor-owned utility company.
- Drafted and negotiated agreements to relocate utility assets in support of large public transportation infrastructure project.
- Supported proposal for IDIQ contract for renewable energy installation with U.S. DOD.
- Developed compliance programs for federal and state grant administration.
- Multi-year retention for a large investor-owned electric utility company to directly advise multiple business units on projects relating to state and federal funding.
Environmental Compliance, Regulatory and Enforcement Matters
- Resolved environmental challenges to highly politicized Brownfield development for Fortune 500 real estate development company.
- Settled investigation into California VOC labeling compliance for large retail consumer products store.
- Advise on Prop 65 labeling and warning compliance.
- Supervised day-to-day operation of EHS compliance program for the large retail home improvement store. Improved the company-wide inspection record by greater than 50 percent.
- Settled investigation by state prosecutorial taskforce into corporate hazardous waste management practices with a 90% reduction in civil penalty.
- Negotiated consent judgment with no civil penalty with EPA Region III for alleged violations relating to elevated lead content of publicly-supplied drinking water.
- Developed nationwide employee compliance programs for hazardous materials, hazardous waste and fire code management for more than 2000 retail facilities.
